Overview

Delhi Pollution Control Committee is responsible to issue a license called “DPCC license”.  DPCC is governed and regulated by ministry of Environment & Forests & climate change. DPCC is a kind of no objection certificate which government issues to make sure that the existing business or proposed business model are not causing any harm to the environment and will not affect it in the near future as well. With the different changes in the method for living or Development or Capacity improvement or Production procedure or setting up in industries, the Entrepreneurs are required to acquire first the "No objection" Certificate from the Board as recommended by the Law.

Under u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 government has made it compulsory that no person has the right to establish any industry or involve in any sort of treatment and disposal of the waste without having DPCC consent.

DPCC has its reality since 1991 and is an independent body. The Central Pollution Control Board (CPCB) has voluntarily assigned all its responsibilities and functions to the DPCC.

The Environmental Pollution (Prevention and Control) Authority (EPCA), followed by various organizations, is regulated by the DPCC and the respective offices guarantee strict action against illegal businesses.

Registration process

  • All industries looking for the first consent certificate must verify their business activity.
  • After verification is complete, industries are further classified on the basis of business activity.
  • For the white category, industry documents can be submitted online and an undertaking is generated later. The business entity must submit a hardcopy to DPCC with a signature.
  • Speaking of the Green and Orange category, it is necessary to check whether the site falls in the list of industrial zones if the industry submits the documents online on the DPCC official website.
  • If the site is under redevelopment area, the SDM letter or industry evaluation letter at that point must be given in the event that the site is not subject to rebuttal at that point of the DPCC montage.
  • Once the investigation is complete, the industry must submit the necessary documents on the web. After which CTE is produced. The business must present a hard copy of the CTE application along with the signature. After a while, the board gives a CTE announcement.
  • Lastly, the industry needs to find out if there is any need for pollution control equipment. If the answer is affirmative then the devices of pollution control equipment need to be installed. The CTO application is then generated. The industry has to submit the CTO application to DPCC along with the signature. After all the verification is done, the CTO certificate is issued.

Types of industries

DPCC has classified industrial activities into White, Red, Green and Orange categories. These categories are decided on the basis of pollution capacity as already mentioned on the DPCC website.

  • White Category

    In 2016, the government has come with the concept of ‘White Category’. The category is launched with an attempt to segregate the least polluting industry. However, these industries do not require any consent certificate due to their non-polluting nature. Baby carriage, pesticide, air cooler, handloom, medical oxygen, organic manure are the industries that cover this area./p>

  • Red Category

    Ministry of Environment & The forests have placed highly polluting industries in the red category. Additionally, they are not allowed to work in environmentally fragile or assured areas. There are some red category industries which deal with hazardous chemicals, automobiles, mining, bio-medical waste etc. The red category includes commercial areas whose pollution index is above 60. 

  • Green category

    Industries with a pollution index of 21 to 40 fall under the Green category. It is necessary for these industries to submit consent before creating an industry.

  • Orange Range

    These industries cover a pollution index of 41 to 59. Orange category industries cannot start their business without presenting a consent certificate.

grant period

Period for which consent to work and consent to work have been granted by DPCC in Green and Orange category industries:

  • Consent to Establish: It is accepted for a period of one year for the construction of the unit for all units acceptable for running in Delhi.
  • Consent to operate: It is considered for 10 years of green category industries.
  • Consent to work: It is given to Orange category industries for 5 years.
